1. About this policy
This policy applies to everyone who uses Orbis Status, which is provided by Orbis Digital Ltd ("we"). It forms part of our Terms & Conditions. You are responsible for what you and your team members publish and send.
2. Lawful use
You must use Orbis Status lawfully. Among other things, you must:
- follow UK GDPR and the Data Protection Act 2018 when you handle personal data, including telling subscribers how their email address is used;
- follow PECR when you send emails to subscribers;
- follow advertising and consumer law, including the CAP Code;
- hold the rights to the text, images and logos that you publish;
- follow any extra rules that apply to your sector.
3. Prohibited content
You must not use Orbis Status to send or publish content that:
- is illegal, or encourages illegal activity;
- is fraudulent or deceptive, including scams and phishing (see also the Fraud Act 2006);
- is hateful, harassing, threatening or discriminatory;
- sexually exploits or endangers children, or is sexually explicit;
- promotes violence, terrorism or self-harm;
- infringes somebody else's intellectual property or privacy;
- spreads false information that is likely to cause harm.
4. Impersonation and phishing
A status page must only speak for you, or for a client who has given you permission. You must not use a status page to impersonate another organisation, to pretend to be a service you do not run, or for phishing. That includes pages that copy another organisation's name, logo or brand, links that try to collect logins or payment details, and incident updates written to trick people into acting.
5. Status pages, domains and accounts
Only create status pages for organisations you are authorised to represent, and only point a custom domain at a page if you control that domain. If you manage pages for a client, you must have the client's permission. Keep status information truthful: do not publish fake incidents or false claims about uptime. Remove access when somebody no longer needs it, and do not share logins.
6. Subscriber emails
You must only send emails to people who have agreed to receive them. Do not add people to your subscribers yourself, and do not import lists of people who have not agreed. Do not use status emails for marketing or unsolicited bulk messages. Respect unsubscribes straight away. Do not try to get around email limits or filters.
7. Technical misuse
You must not try to gain unauthorised access to Orbis Status or to other customers' accounts (see the Computer Misuse Act 1990), interfere with the service, introduce malicious code, scrape or reverse engineer the service, misuse the API or API keys, or use it to build a competing product.
8. Monitoring and enforcement
We may investigate suspected breaches. If we reasonably suspect a breach, a security risk or unlawful content, or if a regulator tells us to act, we may remove access to content, or suspend or close accounts. Where appropriate, we will tell you what we have done and why. We may report illegal activity to the authorities.
9. Reporting abuse
To report misuse of Orbis Status, such as a status page that impersonates an organisation, email support@orbisdigital.co.uk, including a link to the page where you can.
